1.2 Local contact points

Presencia Benelux also uses the following business contact points for professional meetings by prior appointment only. They are not the registered office and do not necessarily provide permanent reception services:

  • Antwerp: Posthofbrug 6, box 5, 2600 Antwerp, Belgium.
  • Brussels area: Culliganlaan 5, 1831 Machelen, Belgium.

1.3 Purpose of the Website

The Website presents Presencia Benelux’s business-to-business services, including local representation, market-entry support, commercial development and practical business assistance for companies seeking to enter or expand in Belgium, the Netherlands and, where relevant, the wider Benelux region.

The information on the Website is general and commercial in nature. Submitting a form, requesting a meeting or exchanging preliminary information does not by itself create a contract, agency, mandate, exclusivity arrangement, partnership, employment relationship or regulated advisory engagement. Any assignment must be expressly accepted and, where appropriate, set out in a written proposal, order form, agreement or contract.

1.4 Access to and use of the Website

By accessing the Website, users agree to comply with these terms as in force at the time of their visit. Users must use the Website lawfully, responsibly and in a manner that respects the rights of Presencia Benelux and third parties.

Users must not:

  • Use the Website for unlawful, fraudulent, misleading or abusive purposes.
  • Provide false, inaccurate or outdated information, or submit another person’s data without authority.
  • Impersonate another person or falsely claim to represent a company or organisation.
  • Introduce malware, malicious code or any material intended to interfere with, overload or compromise the Website.
  • Attempt to gain unauthorised access to systems, accounts, databases or restricted areas.
  • Scrape, extract, reuse or systematically collect Website content or data without prior written permission.
  • Use published contact details for spam, unsolicited mass marketing or abusive communications.

1.5 Illegal activity, fraud and higher-risk engagements

Presencia Benelux does not support illegal or fraudulent activity and will not assist with arrangements intended to conceal the true origin, destination, ownership or purpose of funds, assets, companies or transactions.

Sire Estates BV may reject, suspend or terminate any enquiry, negotiation or business relationship where there are reasonable grounds to suspect fraud, corruption, money laundering, terrorist financing, sanctions evasion, document falsification, impersonation, prohibited trade, infringement of third-party rights or any other activity contrary to applicable law, contractual obligations or the company’s ethical standards.

Where reasonable and proportionate, Presencia Benelux may request information concerning the identity of a company and its representatives, ownership structure, business activity, the purpose of the proposed engagement and the commercial background to a transaction. Each engagement is assessed individually, and no enquiry creates an obligation to accept an assignment.

1.6 Accuracy of information and no regulated advice

Presencia Benelux takes reasonable care to keep the Website accurate and up to date, but does not guarantee that all content is complete, error-free or suitable for a particular situation. Website content does not constitute legal, tax, accounting, financial, employment, customs or investment advice.

Where an assignment requires specialist advice or a regulated activity, the client should obtain advice from a suitably qualified professional. Any introduction to, or coordination with, a third party does not make Presencia Benelux responsible for that party’s services unless otherwise agreed in writing or required by mandatory law.

1.7 Liability

To the fullest extent permitted by law, Sire Estates BV is not liable for loss arising from reliance on general Website information, decisions taken without situation-specific professional advice, temporary interruptions, incompatibilities, malicious software introduced by third parties, or failures of networks and services outside its reasonable control.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing affects any mandatory rights that may apply.

1.8 Third-party websites and services

The Website may contain links to or integrations with third-party services. Their inclusion does not imply endorsement of all content, policies or practices operated by those third parties. Each third party is responsible for its own services and legal terms. Users should review the relevant third-party notices before using an external service.

1.9 Intellectual property

Unless stated otherwise, the Website’s wording, structure, selection and arrangement of content, designs, graphics, logo, business names, photographs and other materials are owned by Sire Estates BV, used with permission or made available under an appropriate licence.

No Website content, the PBNX logo or the Presencia Benelux trading name may be copied, modified, distributed, publicly communicated, extracted, reused or otherwise exploited without prior written permission, except where expressly permitted by law.

The fact that a particular trade mark may not yet be registered does not amount to a waiver of rights arising from prior use, copyright, trade name protection, unfair competition rules or other applicable law. Sire Estates BV reserves the right to take appropriate legal action against unauthorised use or use likely to cause confusion.

1.10 Communications and confidentiality

Email, telephone, WhatsApp and other online communications carry inherent security risks. Users should not send highly sensitive information, critical trade secrets, passwords, full banking credentials or confidential documents until an appropriate channel has been agreed.

1.11 Changes to the Website and these terms

Sire Estates BV may update the Website, its services and these legal texts to reflect legal, technical or operational changes. The date of the latest update will be shown at the beginning of the relevant page.

1.12 Governing law and disputes

The Website and this Legal Notice are governed by Belgian law, without prejudice to any mandatory rules that may apply. The parties will first seek to resolve disputes in good faith. Where this is not possible, and unless otherwise agreed in writing or required by mandatory law, jurisdiction will be determined in accordance with the applicable Belgian procedural rules.
